Update to Customer Information Privacy Rules

In the 87th Legislative Session Bills were passed that Impact the Texas Water Business and in specific regarding the Public Information Act. Section 182.052 of the Utilities Code previously required utilities to keep confidential the address, phone number, social security number, and usage information of their customers, but only if the customer requests that they do so. H.B. 872 flipped this “opt in” confidentiality process to an “opt out” structure. This statute can be found at this link: UTILITIES CODE CHAPTER 182. RIGHTS OF UTILITY CUSTOMERS (texas.gov)
Beginning September 1, 2021, utilities can automatically withhold this information from Public Information Act requests without express permission from their customers. Instead, customers may request that the information be made available on request. In compliance with the Chapter 182, Subchapter B of the Texas Utilities Code that was put in effect as of September 1, 2021, we have adopted a form for your use in this matter.
